After death sentence, what are Kulbhushan Jadhav’s options under Pakistan laws?

Pakistan on Friday listed the options available to Indian national Kulbhushan Jadhav to appeal against the death sentence given to him by a military court on charges of espionage.Sartaj Aziz, the foreign affairs adviser to the prime minister, told a news briefing that the former Indian Navy officer was allegedly “responsible for espionage, sabotage and terrorism” and had been tried according to the law of the land.

Aziz, who read from a statement and did not take questions from the media, then listed the options available to Jadhav under Pakistani law.

“He has the right to appeal within 40 days to an appellate court. He may lodge a mercy petition to the (army chief) within 60 days of the decision by the appellate court,” Aziz said.

“He may lodge a mercy petition to the President of Pakistan within 90 days after the decision of (the army chief) on the mercy petition.”

India has strongly criticised Pakistan for not sharing Jadhav’s whereabouts and details of his condition. It also criticised Pakistan for not adhering to the international norm of providing consular access to a prisoner despite the two countries having an agreement on the issue.

New Delhi has also said that if Islamabad goes ahead with the execution of Jadhav, it would be tantamount to premeditated murder.

Jadhav was reportedly captured in Balochistan in March last year. He was tried by a field general court martial or an army court under provisions of the Pakistan Army Act and the Official Secrets Act.

Aziz said Jhadav was provided with “legal counsel in accordance with provisions of our law” and that he reportedly confessed before a magistrate and the army court that he was tasked by Indian intelligence to “plan, coordinate and organise espionage and sabotage activities”.

Aziz said all political parties of Pakistan were unanimous that the death sentence given to Jadhav was “the correct decision” and the “whole nation is solidly united against any threat to Pakistan’s security”.

Donald Trump’s transition team on Wednesday issued a bland workman-like readout to counter Pakistan’s gushy account of a conversation between the US president-elect and Prime Minister Nawaz Sharif, which created ripples on social media.The two leaders “had a productive conversation about how the US and Pakistan will have a strong working relationship in the future” and Trump was “looking forward to a lasting and strong personal relationship with” Sharif, the transition team said in a rare readout of the president-elect’s conversation with a foreign leader.

The reason for the rare move, said a Trump adviser, was the “flowery” account of Sharif’s phone call to the president-elect to congratulate him on his election that was released by the Pakistani Prime Minister’s Office on Wednesday.

And also the reaction at home. Questions were raised about Trump’s understanding of the region and his position on Pakistan, about whom he has been brutally critical in the past. He had tweeted in 2012: “Get it straight: Pakistan is not our friend.”

Critics said Trump showed little or no awareness of relations with Pakistan and India. “With one phone call, Donald Trump might have upturned America’s relationship with both Pakistan and India,” said New Republic.

Others described the call “unusual” and “surprising”.

But Pakistan was clearly delighted by the effusive praise it heard from Trump. The foreign ministry said on Thursday it welcomed the fact that Trump called Pakistan “amazing” and its citizens “one of the most intelligent people”.

Though Trump did not mention the Kashmir issue, foreign ministry spokesman Nafees Zakaria said Pakistan would welcome his inputs on resolving the matter.

In his call, Trump had offered to play “any role” Pakistan wanted to resolve the country’s outstanding problems. During an interview with Hindustan Times in October, Trump had offered to act as a mediator between India and Pakistan, but only if both sides asked him to. But the Pakistani readout of the conversation seemed to have committed Trump to more than he meant, sources said, prompting the rare counter.

When Indian external affairs ministry spokesperson Vikas Swarup was asked about the conversation, he said, “As far as the ‘fantastic’ conversation is concerned, I have seen a bit of a rejoinder from US side.”

India, Swarup said, has noted Trump’s willingness to address Pakistan’s outstanding issues. “We believe that the most outstanding of outstanding issues is Pakistan’s support of cross-border terrorism. India would welcome the US having a dialogue with Pakistan on this support for cross-border terrorism,” he added.

The Trump transition team has only released readouts of calls he had received from Chinese President Xi Jinping and Russian President Vladimir Putin, but never to counter their account of the conversations. Pakistan was the first to get a it-wasn’t-so response.

According to the Pakistani readout of the conversation, Trump told Sharif “you have a very good reputation. You are a terrific guy. You are doing amazing work which is visible in every way.”

It quoted Trump as saying: “As I am talking to you Prime Minister, I feel I am talking to a person I have known for long. Your country is amazing with tremendous opportunities. Pakistanis are one of the most intelligent people.

“I am ready and willing to play any role that you want me to play to address and find solutions to the outstanding problems.”

On being invited to visit Pakistan, Trump said he would “love to come to a fantastic country, fantastic place of fantastic people”.

Today on my CNN News feed I read another disturbing piece of news that is coming to us from Pakistani police and from their Prime Minister Mr. Nawaz Sharif. This news is of a ‘so-called’ honor killing that has nothing at all to do with anyone’s honor and everything to do with worshiping and serving the Devil Himself. This story goes like this, a 15 yr of girl helped arrange for her best friend and her boyfriend to elope (get married). This happened in a city called Abbottbad in North West Pakistan where ‘Tribal Councils’ tend to be the ‘real’ authorities, not the police or the military. This 15 member Council called a Jirga ordered the death of this young lady. The report says that 13 of those Council members took part in the murder and those 13 have been arrested with a few others. In this case the police have also arrested the girls Mother because  they said she knew in advance what was going to happen and did not tell the police so that made her complicit in the murder. Not mentioned is why the other two members of that Council who also knew were not arrested, why not is my question? The way that these animals chose to murder this young lady is they drugged her, kidnapped her, choked her, chained her to a van and then set the van on fire with her alive inside it. As I said in the title of this article, Devil worshipers. This so called religion that is called Islam has nothing to do with a ‘God’, it only has to do with these folks being raised in Devil worshiping, the good point about this is that these people do not know what they are doing. I totally believe that way over 90% of these disciples of Satan would drop that religion in a flat second if they only the truth about who Allah really is.
